Terms of service

Last updated: 29 October 2026

This is a translation. The German version is the binding one.

These terms govern the use of lumioo, the private photo and video archive at app.lumioo.me, between you and 42ideas UG (haftungsbeschränkt), Ehrenstr. 66, 50672 Köln, Germany ("we"). We write them to be understood; what we mean is what they say.

1. Scope

  1. These terms apply to every lumioo account, free and paid. By registering you accept them.
  2. lumioo is aimed at consumers for private use. Commercial use is permitted unless these terms say otherwise; the rules in section 15 then apply in addition.
  3. Your own deviating terms do not apply.

2. What lumioo is

  1. lumioo stores your photos and videos, shows them in a library, organises them by date, place, albums, tags and people, and lets you create trips with chapters and texts. You can share content through links, download it and export it in full.
  2. Optional features such as automatic tags and face recognition run on our own servers and can be switched on and off individually.
  3. The current feature set, plans and storage limits are described on lumioo.me. We keep developing lumioo; features may be added, changed or removed. We announce material restrictions with reasonable notice.

3. Account

  1. An account requires a valid email address, a password and, as long as we require invitations, an invitation code. You confirm your address with a code.
  2. You must be at least 16 years old. Paid plans require that you are of legal age or act with the consent of your legal guardian.
  3. An account is personal. Keep your credentials secret and tell us if you suspect misuse. What happens through your account is attributed to you unless you are not responsible for the misuse.
  4. You can delete your account at any time in the settings (section 11).

4. Paid plans

  1. Besides the free plan we offer the plans Plus and Studio as well as additional storage packages, each with a monthly or yearly term. Prices and features are shown on lumioo.me and before you buy.
  2. Purchases are handled by Paddle.com Market Ltd, Judd House, 18–29 Mill Street, London SE1 2BA, United Kingdom ("Paddle"), acting as reseller (Merchant of Record). Paddle is the contracting party for the purchase, issues the invoice and receives the payment; Paddle's Checkout Buyer Terms apply to the purchase in addition. The service itself, lumioo, is provided by us.
  3. A plan renews automatically for the chosen term until you cancel. You can cancel at any time for the end of the current term in Paddle's customer portal, linked from the app. You keep using the plan until the end of the term.
  4. There is one subscription per account. Storage packages are added to the subscription and follow its term.
  5. Withdrawal and refunds are covered under Withdrawal and refunds: within 14 days of a purchase or renewal we refund the full amount on request.
  6. Price changes take effect only from the next term and only if we have announced them by email at least 30 days in advance. If you do not agree, cancel for the end of the current term.
  7. A founding member price applies as long as the subscription runs without interruption. After a cancellation the then current price applies if you subscribe again.
  8. If a payment fails, Paddle retries and informs you. If payment is not made, the plan ends and the account falls back to the free plan (section 5).

5. Storage limits and downgrade

  1. Every plan has a storage limit. Deleted content in the trash still counts until it is deleted permanently.
  2. Once the limit is reached you cannot upload anything new until you free up space or extend the plan.
  3. If your account falls back to a smaller plan (cancellation, refund, failed payment, change) and your library exceeds the storage then available:
    • We notify you by email. You have 14 days to delete or export content or to extend the plan again. Two days before the deadline we remind you.
    • After the deadline, on plans without original videos we first remove the original files of videos (the compressed version stays) and then delete, starting with the most recently added items, as much as needed until the library fits the plan. This deletion is permanent and does not go through the trash.
  4. You can start an export of your whole library in the app at any time (section 9). Do that before cancelling a plan if you are over the limit.

6. Your content

  1. Your photos, videos and texts belong to you. You grant us only the right to store them, process them (variants, thumbnails, optional analysis) and display and pass them on as needed for lumioo and for the shares you create. This right ends when the content is deleted.
  2. We do not analyse your content for advertising, do not sell it, do not pass it to third parties and do not train models with it. Image analysis takes place only on our servers and only if you switch it on.
  3. You are responsible for your content. You confirm that you hold the rights needed to store it at lumioo and share it the way you do, and that it violates neither third-party rights nor any law. This applies in particular to photos of other people that you share.
  4. Prohibited in particular: content that infringes third-party rights; depictions of child sexual abuse; glorification of violence, incitement to hatred and other criminal content; malware; using lumioo as a distribution platform for third-party or commercial content without our consent; automated bulk retrieval or attacks on the service.
  5. We do not look at your content. We review it only when shared content is reported or when we are legally required to.

7. Sharing and visitors

  1. Share links are public to anyone who knows the link unless you set a password. Choose expiry, password and options to suit the content. You can revoke links at any time.
  2. Visitors need no account. You decide whether they may see info, comment, download or follow a trip. Visitors are responsible for their own comments; you can delete them.
  3. Visitors can report content. We review reports and may, in case of violations, block sharing, delete content or disable the account (section 12). We never act on a report automatically.

8. Availability

  1. We run lumioo with care but cannot guarantee uninterrupted availability. Where possible we announce maintenance in the app.
  2. We back up the database and files regularly (database daily, files continuously) and keep backups for up to 7 and 30 days respectively. Backups serve to restore after a failure on our side, not as a replacement for your own backup. Keep originals that matter to you in a second place as well.

9. Export, API and connected applications

  1. You can download a selection or export your whole library at any time. Full exports are limited to one per 30 days.
  2. You can create API keys and give third-party applications (such as AI assistants) access to your library through an authorisation page. What an application you authorised does with your data is its and your responsibility. You revoke authorisations and keys at any time in the settings. Write access through the API is reserved for the Plus and Studio plans.

10. Trash

Deleted photos and videos stay in the trash for 30 days and can be restored during that time. After that they are deleted permanently. Content deleted because of a downgrade (section 5) or a violation (section 12) does not go through the trash.

11. Term and account deletion

  1. The user contract runs for an indefinite period. You can end it at any time by deleting your account in the settings.
  2. Deletion is carried out after 14 days; during that time you can cancel it. Optionally you delete immediately. After that all content and the account are gone irrevocably, backup copies after their retention period (section 8).
  3. You must cancel a running paid subscription in the Paddle portal first; account deletion is only possible once the subscription is cancelled. There is no refund for the remaining term except under the 14-day rule.
  4. An open report against content you shared pauses deletion until it has been handled.
  5. We may terminate the contract with 30 days' notice by email, for example if we discontinue lumioo. In that case you have until the end of the notice period to export; a paid plan is refunded pro rata.

12. Blocking and termination for violations

  1. If you violate section 6 or 7 we may, depending on severity, block sharing of individual content, delete content, temporarily disable the account or terminate the contract without notice. We choose the mildest measure that ends the violation and inform you, unless this is legally prohibited or would defeat the review.
  2. You can respond to any measure; write to support@lumioo.me.
  3. On termination without notice there is no refund for the remaining term.

13. Liability

  1. We are liable without limitation for intent and gross negligence, for damage from injury to life, body or health, under the Product Liability Act and where we have given a guarantee.
  2. For slight negligence we are liable only for the breach of essential contractual obligations, that is, obligations whose fulfilment makes the use of lumioo possible in the first place and on whose observance you may rely, and then limited to the foreseeable damage typical for the contract at the time it was concluded.
  3. Otherwise liability is excluded. This also applies to loss of data to the extent it could have been avoided by reasonable backups of your own (section 8).
  4. For the free plan we are additionally liable only if the damage is due to intent or gross negligence or concerns life, body or health.

14. Privacy

How we handle your data is set out in the Privacy policy. It is part of this agreement.

15. Commercial use

If you use lumioo as a business, the following applies in addition: the place of jurisdiction is Köln (Cologne); the UN Convention on Contracts for the International Sale of Goods is excluded; the liability cap in section 13 (2) is limited to the fees of the last twelve months; consumer protection provisions do not apply.

16. Changes to these terms

  1. We may change these terms if the legal situation, case law, market conditions or lumioo itself change and the change is reasonable for you. We do not change the main service this way.
  2. We announce changes by email at least 30 days before they take effect. If you do not object before they take effect, or keep using lumioo afterwards, the new terms apply. We point out this consequence in the announcement. If you object, you can cancel the account before the changes take effect; a paid plan is then refunded pro rata.

17. Final provisions

  1. German law applies. If you are a consumer residing in another EU or EEA state, the mandatory consumer protection provisions of your state of residence remain unaffected.
  2. The German version of these terms is binding. The English version is provided for understanding.
  3. Should a provision be invalid, the remaining provisions remain in effect.
  4. The European Commission no longer provides a platform for online dispute resolution. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
